  1. These terms

    1. What these terms cover.These are the terms and conditions that govern your subscription to RoadHow Rewards. (Rewards Terms and Conditions)

      These Rewards Terms and Conditions do not apply to your subscription to RoadHow Premium – RoadHow Premium is a separate subscription and is governed by the terms and conditions of your App Store provider (for example, Apple or Google) and the RoadHow App Terms of Use.

    2. Why you should read them. Please read these Rewards Terms and Conditions carefully before you decide to subscribe to RoadHow Rewards. These Rewards Terms and Conditions tell you who we are, the terms of your subscription to RoadHow Rewards, how you and we may change or end your subscription, what to do if there is a problem and other important information.

  2. Information about us and how to contact us

    1. Who we are. We are Trigen Limited, trading as RoadHow, a company registered in England and Wales. Our company registration number is 11796092 and our registered office is at c/o Browne Jacobson LLP, Victoria Square House, Victoria Square, Birmingham, United Kingdom B2 4BU.

    2. How to contact us. You can contact us by emailing us at support@roadhow.co.uk or by writing to us at RoadHow, PO Box 17700, SOLIHULL, B93 3JS.

    3. How we may contact you. If we have to contact you, we will do so by writing to you at the email address you provided to us when you signed up, or via push notifications if you use the RoadHow App and have enabled push notifications.

    4. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

  3. Our contract with you

    1. How we will accept your subscription to RoadHow Rewards.Our acceptance of your subscription to RoadHow Rewards will take place when we notify you in writing that we accept it, at which point a contract will come into existence between you and us.

    2. RoadHow’s acceptance. Our acceptance email will detail the type of subscription you have chosen, the minimum period of that subscription, the total price and, if applicable, the monthly price of that subscription. This information will also be available via your account, along with a copy of the Rewards Terms and Conditions that were applicable at the time you subscribed to the RoadHow Rewards.

    3. If we cannot accept your subscription. If we are unable to accept your subscription, we will inform you of this and will not charge you. This might be because of unexpected limits on our resources which we could not reasonably plan for or because we have identified an error in the price or description of the subscription etc.

  4. RoadHow Rewards

    1. RoadHow Rewards. A subscription to RoadHow Rewards will enable you to access the fantastic deals and discounts offered by our specially selected partners (RoadHow Partners).

    2. RoadHow Partners. Our RoadHow Partners and the deals and discounts they offer may change from time to time (examples of our RoadHow Partners can be seen within the RoadHow App). Once subscribed, you can view the RoadHow Partners’ deals and discounts by logging into RoadHow Rewards. Please be aware that RoadHow is likely to receive money from the RoadHow Partners for featuring them in RoadHow Rewards.

    3. Your contract with our Roadhow partners. When you take advantage of any of the deals and discounts offered by the RoadHow Partners via RoadHow Rewards, your contract for the purchase of those goods and/or services will be between you and the relevant Roadhow Partner. As such, any queries or problems relating to your purchase should be directed to the relevant RoadHow Partner.

  5. Our rights to make changes to RoadHow Rewards

    1. Minor changes. We may change RoadHow Rewards:

      1. to reflect changes in relevant laws and regulatory requirements;

      2. to implement minor technical adjustments and improvements, for example to address a security threat. These changes will not affect your use of RoadHow Rewards; and

      3. to update the deals and discounts available and to occasionally change the RoadHow Partners.

  6. Price and payment

    Please note that your subscription to RoadHow Rewards is separate to your paid subscription to RoadHow Premium. This means that your RoadHow Rewards subscription is charged for and cancellable in accordance with these Rewards Terms and Conditions only, not your App Store Provider’s Terms and Conditions.

    1. Subscription models. The two RoadHow Rewards subscription models are:

      1. Annual subscription (payable monthly). This is an annual (12month) pay-monthly subscription, where payment is taken on the same date each month; and

      2. Annual subscription (payable yearly). This is an annual (12month) subscription, where full payment is taken on the beginning of your subscription.

    2. Renewals. Both the annual (payable monthly) subscription and the annual subscription (payable yearly) will automatically ‘roll over’ at the end of the initial 12month period (Initial Period) for successive 12 month periods (each of which are called a Renewal Period) unless you tell us that you want to cancel your subscription to RoadHow Rewards at the end of the Initial Period or current Renewal Period. RoadHow will inform you of the upcoming renewal within the month before your Initial Period or current Renewal Period is due to expire.

    3. Where to find the price for your subscription. The price of a subscription (which includes any applicable VAT) will be the price indicated on the subscription pages when you go through the sign-up process.

    4. How you must pay. We accept payment with all major credit and debit cards.

    5. What to do if you think a bill is wrong. If you think a bill is wrong, please contact us promptly to let us know and we shall investigate the matter.

  7. Providing RoadHow Rewards

    1. When we will provide RoadHow Rewards. We will make RoadHow Rewards available to you for the duration of your subscription (subject to you or us ending the subscription early).

    2. We are not responsible for delays outside our control. If RoadHow Rewards are delayed or temporarily unavailable by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay and/or unavailability. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay (more than 96 hours in any month) you may contact us to end your subscription.

    3. Reasons we may suspend your subscription. We may have to suspend your subscription:

      1. to deal with technical problems or make minor technical changes;

      2. to update the product to reflect changes in relevant laws and regulatory requirements;

      3. to make changes to the RoadHow website and RoadHow Rewards as requested by you or notified by us to you (see clause 5);

      4. if you breach any other RoadHow terms and conditions that may apply to you in respect of your use of RoadHow services, for example, the RoadHow App Terms of Use.

  8. Your rights to end your subscription

    1. Ending your subscription because of something we have done or are going to do. If you are ending your subscription for a reason set out at 8.1.1 to 8.1.3 below, your subscription will end immediately and we will refund you in full for all payments made for any period of the subscription which has been affected by the scenarios listed below, and for any advance payments that relate to an unused period or portion of your subscription. You may also be entitled to compensation. The reasons are:

      1. we have told you about a material upcoming change to RoadHow Rewards or the Rewards Terms and Conditions which you do not agree to;

      2. we have told you about an error in the price or description of your subscription and you do not wish to proceed;

      3. you have a legal right (whether a statutory right or a common law right) to end the contract because of something we have done wrong.

    2. Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most products and services bought online you have a legal right to change your mind within 14 days and receive a refund. These rights are contained in the Consumer Contracts Regulations 2013.

    3. How long do I have to change my mind? You have 14 days after the day we email you to confirm we accept your subscription to RoadHow Rewards. If you cancel after you have started using RoadHow Rewards, and you have acknowledged that your right to cancel may be affected by beginning the RoadHow Rewards, you must pay us for the services you have used up until the time you tell us that you have changed your mind.

    4. Ending your annual subscription (payable monthly) where we are not at fault and there is no right to change your mind. If you are paying monthly for an annual subscription, you may end it at any time. However, RoadHow will continue to take monthly payments until the point in time at which your Initial Period or Renewal Period was due to expire. For example, if you subscribed to an annual (pay monthly) subscription on 22 May 2020 and decided to cancel it on 26 February 2021, RoadHow would continue to take monthly payments until 22 April 2021 (i.e. the end of your Initial Period).

    5. Ending your annual subscription (payable yearly) where we are not at fault and there is no right to change your mind. If you have paid for an annual subscription, you may end it at any time. However, you will usually not be entitled to a refund of fees already paid.

  9. How to end your subscription (including if you have changed your mind)

    1. Tell us you want to end your subscription to RoadHow Rewards. To end your subscription to RoadHow Rewards, please let us know by doing one of the following:

      1. Email. Email us at support@roadhow.co.uk. Please provide your name, account number and your email address. Please also provide a clear statement of your intention to change your mind under clause 8.2, or of your wish to cancel the subscription to RoadHow Rewards under clauses 8.1, 8.4, or 8.5 (as applicable).

      2. Online. Complete the RoadHow Rewards subscription cancellation process in the RoadHow App.

      3. By post. Write to us at our PO Box (see clause 2.2), providing your name, account number and your email address. Please also provide a clear statement of your intention to change your mind under clause 8.2, or of your wish to cancel the subscription to RoadHow Rewards under clauses 8.1, 8.4, or 8.5 (as applicable).

      If you are exercising your right to change your mind under clause 8.2, you may also complete the model cancellation form found at the end of these Rewards Terms and Conditions and email or post it to us.

    2. How we will refund you. If we owe you a refund after you end your subscription, we will refund you by the method you used for payment. However, we may make deductions, as described below.

    3. Deductions from refunds if you are exercising your right to change your mind. If you are exercising your right to change your mind, we may deduct from any refund an amount for your use of RoadHow Rewards for the period for which they were supplied, ending with the time when you told us you had changed your mind. The amount will be in proportion to what has been used by you, in comparison to what we would expect an average customer to use over a subscription period. This amount will also take into account our costs in making RoadHow Rewards available to you.

    4. When your refund will be made. We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind then your refund will be made within 14 days of your telling us you have changed your mind.

  10. Our rights to end the contract

    1. We may end your subscription if you break these Rewards Terms and Conditions. We may end your subscription at any time by writing to you if:

      1. you do not make any payment to us when it is due and you still do not make payment within 14 days of our reminding you that payment is due;

      2. you do not, within a reasonable time of our asking for it, provide us with information that is necessary for us to make RoadHow Rewards available to you; or

      3. you breach any other RoadHow terms and conditions which may apply to you, for example, the RoadHow App Terms of Use.

    2. You must compensate us if you break these Rewards Terms and Conditions. If we end your subscription in the situations set out in clause 10.1, any refund will be at our discretion.

  11. If there is a problem with your subscription

    How to tell us about problems. If you have any questions or complaints about RoadHow Rewards, please contact us. You can email us at support@roadhow.co.uk or write to us at RoadHow, PO Box 17700, SOLIHULL, B93 3JA.

  12. Our responsibility for loss or damage suffered by you

    1. We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Rewards Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the subscription process.

    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the subscription.

    3. If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage which was not caused by us failing to use reasonable care and skill, which you could have avoided by following our advice to apply an update offered to you free of charge, or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.

    4. We are not liable for business losses. Subscriptions to RoadHow Rewards are for domestic and private use only. If you use the products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity and our total liability shall be capped at the subscription fees we have received from you in the previous six months.

  13. How we may use your personal information

    We will only use your personal information as set out in our Privacy Notice at www.roadhow.co.uk/legal/privacy-policy.

  14. Other important terms

    1. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

    2. Which laws apply to this contract and where you may bring legal proceedings. These Rewards Terms and Conditions are governed by English law and you can bring legal proceedings in respect of your subscription in the English courts. If you live in Scotland you can bring legal proceedings in respect of your subscription in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of your subscription in either the Northern Irish or the English courts.

    3. Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint, you may want to contact your local Trading Standards Services which can found at https://www.tradingstandards.uk/consumers/support-advice.
